Punishments for Article 120c UCMJ Indecent Recording

UCMJ Article 120c, established in 2019, addresses various sexual misconduct offenses, including indecent recording. Indecent recording involves creating visual recordings of another person’s private area without their consent and when they have a reasonable expectation of privacy.

Punishments for indecent recording under Article 120c can vary depending on the circumstances and any aggravating factors. Generally, the maximum punishment includes a dishonorable discharge, forfeiture of all pay and allowances, and confinement for up to five years. However, for offenses committed after December 27, 2023, the maximum confinement is reduced to three years.

The actual sentence imposed may be less severe, and the military judge will consider several factors when determining the appropriate punishment, including the severity of the offense, the offender’s rank and service record, and any mitigating or aggravating circumstances. If the indecent recording was broadcasted or distributed, the maximum confinement could increase to seven years for offenses committed before December 27, 2023.
