Pretrial orders

Overview of pretrial orders:

  1. The military judge may issue pretrial orders that regulate when the parties will provide notices and make disclosures to the other party.
    1. “The military judge may, consistent with this rule, specify the time, place, and manner of making discovery and may prescribe such terms and conditions as are just.” RCM 701(g)(1)
    2. The judiciary “may make rules of court not inconsistent with these rules for the conduct of court-martial proceedings.” RCM 108.
