Inside the Selective World of Military Defense Lawyers: How Elite Attorneys Choose and Defend Military Sexual Assault Cases

When facing a serious military criminal charge, such as a sexual assault under Article 120 of the Uniform Code of Military Justice (UCMJ), choosing the right defense attorney can be the difference between freedom and conviction. But what many people don’t realize is that elite military defense lawyers don’t take every case that comes their way. In a revealing discussion, criminal defense attorney Michael Waddington shares how he and his law firm, Gonzalez & Waddington, carefully vet potential clients accused of military sexual misconduct and build formidable defense teams. This blog post dives deep into their selective process, the importance of client-lawyer chemistry, and how top-tier military defense attorneys prepare to win tough cases.

The Art of Selecting Good Clients

Michael Waddington opens by highlighting a key truth in elite criminal defense: not every potential client fits the bill. This selectivity is rooted in a desire to provide the highest quality defense and to work with clients who respect and trust their legal team. According to Waddington, many callers seeking representation are understandably scared and overwhelmed. However, the firm evaluates the nature of each case and the client’s attitude before proceeding.

  • Client Character and Respect: The firm prioritizes clients who demonstrate integrity, respectfulness, and a willingness to collaborate. Disrespectful or dishonest behavior during initial contact often signals future challenges, so such cases are declined.
  • Working as a Team: Defense is a collaborative effort. Clients must be willing to put in the effort alongside their attorneys. Waddington emphasizes that his firm becomes intimately involved in the client’s life throughout the process, from initial investigation to courtroom defense.
  • Long-Term Relationships: The firm values lasting relationships, often maintaining contact with clients well beyond case resolution, underscoring the mutual respect and trust foundational to their representation.

Why Selectivity Matters in Military Sexual Assault Defense

Military sexual assault cases are some of the most complex and high-stakes matters in military law. False accusations can irreparably damage careers and lives, while legitimate cases require a robust, strategic defense. Waddington’s firm fights false sexual assault claims worldwide, bringing expertise not only in military law but also in related state and federal jurisdictions.

Elite defense lawyers like Waddington and his partner Alexandra Gonzalez-Waddington focus on cases where they can make a tangible difference, often involving complicated legal issues, high-profile circumstances, or where their specialized knowledge can be pivotal. This focus enables them to commit resources effectively, including expert witnesses, investigators, and advanced technology.

Building a Winning Defense Team

Forming a successful defense in military sexual assault cases involves more than just a skilled attorney. It requires a team with diverse expertise and a collaborative mindset. Waddington’s approach includes:

  • Experienced Attorneys: The core team brings complementary skills, from courtroom advocacy to forensic analysis.
  • Expert Witnesses: Medical professionals, forensic scientists, and other specialists lend credibility and clarity to complex evidence.
  • Private Investigators: Investigators uncover new evidence, interview witnesses, and verify facts that may be crucial to the defense.
  • Support Staff and Technology: Paralegals, legal assistants, and the use of cutting-edge technology ensure efficient case management and compelling presentations.
  • Client Involvement: Clients are active participants, providing insights and helping shape defense strategies.

Ethics, Financial Considerations, and Reputation

Waddington also highlights ethical considerations in client selection. Taking on a case that conflicts with an attorney’s moral compass or professional ethics can compromise the quality of defense. Financial capability is another factor since mounting a strong defense in military sexual assault cases often involves significant expenses.

Moreover, attorneys must consider the potential publicity of a case. High-profile cases can enhance a lawyer’s reputation but also bring intense scrutiny. Balancing these factors is essential to maintain integrity and focus on the client’s best interests.

Advice for Potential Clients Seeking Military Sexual Assault Defense

Waddington offers crucial advice to individuals seeking representation for military sexual assault charges:

  • Understand that the attorney-client relationship is a two-way street — respect, trust, and communication are vital.
  • Be honest and forthcoming with your legal team; dishonesty can undermine your defense.
  • Recognize that a lawyer who takes your case without any vetting may not provide the dedicated, personalized defense you need.
  • Provide detailed and accurate information when contacting a law firm to facilitate their evaluation process.
  • Prepare to work closely with your legal team through every stage of the legal process.

Conclusion

The defense of military sexual assault cases under Article 120 UCMJ is a specialized and demanding practice area. Michael Waddington and his firm exemplify how elite military defense lawyers carefully select clients and cases to ensure they can provide top-tier representation. Their approach, grounded in respect, integrity, and teamwork, highlights that successful defense is about more than legal knowledge — it’s about relationships, strategy, and comprehensive preparation.

If you or a loved one is facing a military sexual assault allegation, understanding the importance of client-attorney compatibility and the rigorous vetting process can empower you to make informed decisions. For those seeking expert defense, reaching out to seasoned professionals like Gonzalez & Waddington can be a critical first step towards justice.

My name is Michael Waddington and I’m a criminal defense attorney. When we get phone calls from people that are seeking representation, we can’t take many of those cases. We very carefully screen what calls we take and what cases to take because we’re looking for very specific types of cases and very specific types of clients. We are not in the practice of taking on cases that we don’t really care about, cases where the client is rude, narcissistic, doesn’t want to work with us, or lies to us. We’ve been very privileged and lucky in being able to take on select cases and we’ve actually been able to represent a lot of really good people, people that we keep in contact with to this day. Even people that I represented back in the day when I was in the Army Trial Defense Service back in 2003 and up until 2006, I still keep in touch with some of those clients. Those are the types of people that we want to represent, the people that we want to defend. People that have integrity, people that want to stand up for themselves and defend themselves and have us defend them. People that put their trust in us. We also want people that are respectful, that are good people at heart. When we get phone calls and messages through our website, that’s when our screening process begins. We determine a lot of things from the initial feedback, from the chats and from what is said to the receptionist. If the person’s rude, disrespectful, arrogant, or just a jerk towards a receptionist, we don’t want to represent them. We don’t want their case because that’s a red flag that that is how they’re going to act towards us, towards my office staff, towards my co-counsel that I end up working with in the military, or towards everyone around them. Now we understand that when you call us or contact us, a lot of you are scared, you’re nervous, you’re facing various serious life-altering events, and you’re looking for help. But at the same time, we are also looking to see who we want to bring into our life because when my wife and I, my wife Alexandra and I are law partners, we’ve been married for 25 years, went to law school and college together, we have two kids together who are in law school. We want to bring people into our lives because if we take you on as a client, we are bringing you into our life. We are going to be dealing with you, talking to you, defending you, reviewing your file, discussing you from the beginning of our representation until the case is done and even afterwards. So we want people in our lives that really appreciate us, respect us, and want us to help them and want to work together as a team because that’s really what you’re doing is you’re bringing our team on to help you and we become a team. So when I go into court, if we end up at court, I’m going to be sitting next to you in the courtroom, sometimes for a week or two weeks. We’re going to be working from early in the morning to late at night. I’m going to be interacting with your family, with your f
